Contract law training: more firms suing their legal advisors
15 January 2009
The importance of contract law training has been emphasised by the increasing number of businesses pursuing legal action against their advisors.
Richard Portlock, a partner at Blake Lapthorn, tells the Lawyer that changes in the way companies seek advice complicates the issue of liability where professional negligence has caused problems.
He says an issue arises in determining which of a business's advisors are in breach of their contractual responsibility to provide services with due care
Meanwhile, Sarah Clover, a partner at Barlow Lyde and Gilbert, claims firms are increasingly scrutinising their own contracts to ensure their lawyers have not overlooked anything.
She tells the news provider these organisations' understanding of contract law can lead to cases being filed against the businesses' official legal representation.
In other contract law news, the UK Border Agency has suspended a member of staff after he falsely signed a statement asserting he was not a member of the British National Party.
