Training 'could provide defence against harassment claims'

A company which has offered training in discrimination and equality policies could have a defence against allegations of harassment, a law firm asserts.

David Hoey, speaking on behalf of law firm Brechin Tindall Oats, tells the Firm magazine if an employer can show it took all reasonably practical steps to prevent the harassment taking place it can dispute this type of complaint.

He states it is important the company can have an atmosphere where allegations of this type can be discussed openly and taken seriously.

Among the key areas the expert states can be affected by an employment tribunal are reputation, morale and finances, the news provider reports.

Mr Hoey says fines for harassment complaints are unlimited and legal fees can increase the damage this can cause.

He states: "Employers must therefore ensure so far as possible that they do everything within their power to prevent such harassment from arising, including introducing a diversity policy, keeping it up to date and training staff regularly."
